Can you Really do What you Want with your Hair?
2016 and you still canât wear your locs to work! Huffington Post recently reported that a federal appeals court maintained that it is ok to discriminate against the traditional black hairstyles. In 2014, a claim ruling that racial discrimination had to be based on characteristics that did not change, and the hairstyle did not qualify as âimmutableâ.
The 11th U.S. Circuit Court of Appeals recently upheld the claim with a 3-0 ruling; this means employers can continue to ban hairstyles, such as dreadlocks at work. Some may view the ruling as racial discrimination, but U.S. Circuit Judge Adalberto Jordan wrote a statement to clarify: Discrimination on the basis of Black hair texture is prohibited by Title VII, while adverse action on the basis of black hairstyle is not. So basically it is legal by law to discriminate against people with locs.
